Re: Local Agency Formation Commission Subcommittee
Dear Chairman Jackson:
It has come to our attention that you recently forwarded to the members of the subcommittee of the Local Agency Formation Commission (LAFCO) a letter indicating that the subcommittee had fulfilled its obligations and was no longer needed by the Commission.
As I recall, the subcommittee was formed by an action of the full Commission, and, as a result, in our opinion, the Commission would need to take action to terminate the subcommittee for the subcommittee to no longer function.
As these special reorganization proceedings move forward, it is especially important to eliminate as many issues as possible which might be used to attack the final results of the Commission's actions. As you may be aware, in a fairly recent case the appellate court upheld an attack on another LAFCO 's final action because the LAFCO had not followed its own procedures. Therefore, it is our recommendation that the subcommittee continue to function until such time as the Commission has determined that the subcommittee is no longer a necessary element for this process.
